Human Rights violations in Thailand have worsened after the coup in May 2014 and the situation remains worrying, according to the Office of the UN High Commissioner for Human Rights (OHCHR).
Speaking today (11 Aug) to reporters in Geneva, Human Rights Office spokesperson Ravina Shamdasani said, "We are appalled by the shockingly disproportionate prison terms handed down over the past few months in lèse majesté cases in Thailand. On the 7th August, the Bangkok military court sentenced to travel agents to 30 years in prison for violating section 1.1.2. of the criminal code which is also known as the lèse majesté code. He was convicted for posting 6 comments critical of members of the Royal family on facebook. Then sentence was initially 60 years, that is 10 years for each of his face book post. But this was reduced due to his guilty plea."
She noted cases where people are convicted as violation of their right to expression have been constantly increasing, adding in, "On the same day the military court in Shanghai handed a 28 year prison term to a woman working in a hotel for posting 7 comments on face book that were critical of the monarchy. The sentence was reduced from 56 years because of her guilty plea."
The junta in Thailand has prosecuted hundreds of its critics in military courts, engaged in widespread censorship, blocked more than 200 websites, and banned public gatherings
Ravina Shamdasani also said that "another particularly harsh sentence was handed down in March when the Bangkok military court convicted a man to 25 years to prison for posting 5 comments for criticising the monarchy on facebook. These are the heaviest sentences that we have recorded since 2006 when we began documenting cases of individuals prosecuted for lèse majesté offenses for exercising their rights for freedom of expression".
OHCHR is also concerned about the treatment of people with mental disabilities.
The spokesperson added, "Also among those convicted in recent months are people with psycho-socialo disabilities. On the 6 August the Shanghai military court sentenced a man to 5 years to prison for destroying a portrait of a king while he was intoxicated. He has been diagnosed with psychosis by the hospital and has been taken medication to battle visual and auditory hallucinations."
The military staged at the coup on May 22, 2014, established the National Council for Peace and Order (NCPO) which has severely repressed the rights to freedom of expression, association and peaceful assembly, detained hundreds mostly without charge, and tried civilians in military courts with no right to appeal.
OHCHR's Shamdasani continued,"We are also alarmed at the spike in harsh present terms delivered in such cases by the military courts which themselves failed to meet international human rights standards, including the right to a fair trial. Observers have been banned from entry and in many instances there is no option for appeal. International law requires that trials of civilians by military courts should be exceptional and military trials must afford all the process guarantees provided for under the national human rights law."

โฆษกประจำตัวข้าหลวงใหญ่เพื่อสิทธิมนุษยชนแห่งสหประชาชาติ ระบุว่า สำนักงานข้าหลวงใหญ่แห่งสหประชาชาติมีความหวาดวิตกอย่างมากจากคำพิพากษาจำคุกคดีหมิ่นพระบรมเดชานุภาพในหลายๆ เดือนที่ผ่านมาซึ่งมีการระวางโทษจำคุกอย่างไม่มีสัดส่วน (disproportionate) อย่างมีความรุนแรงมาก ในวันที่ 7 สิงหาคม 2558 ศาลทหารกรุงเทพ ตัดสินจำคุกนายพงษ์ศักดิ์ เจ้าหน้าที่บริษัททัวร์เป็นระยะเวลา 30 ปีจากการละเมิดมาตรา 112 จากการเขียนความเห็นในเฟซบุ๊กวิพากษ์วิจารณ์ราชวงศ์ไทย นายพงษ์ศัดิ์ถูกตัดสินจำคุกเป็นระยะเวลา 60 ปี หรือ 10 ปี ต่อ 1 ความเห็น แต่ถูกลดลงเนื่องจากนายพงษ์ศักดิ์รับสารภาพ ในวันเดียวกันศาลทหารจังหวัดเชียงใหม่พิพากษาจำคุกนางสาวศศิวิมล พนักงานโรงแรมแห่งหนึ่ง เป็นระยะเวลา 28 ปี จากการแสดงความเห็นบนเฟซบุ๊กที่วิพากษ์วิจารณ์สถาบันกษัตริย์ คำตัดสินนี้ถูกลดลงจาก 56 ปี เนื่องจากนางสาวศศิวิมลรับสารภาพ ในเดือนมีนาคม 2558 ศาลทหารกรุงเทพได้มีคำพิพากษาที่รุนแรงโดยตัดสินจำคุกนายเธียรสุธรรม เป็นระยะเวลา 25 ปี (จากโทษเต็ม 50 ปี) จากการโพต์ความเห็น 5 ครั้งบนเฟซบุ๊กที่มีข้อความวิจารณ์สถาบันกษัตริย์
“คำพิพากษาข้างต้นนับเป็นคำตัดสินคดีที่รุนแรงที่สุดนับตั้งแต่ปี 2549 เป็นต้นมา ซึ่งเป็นปีที่เราเริ่มรวบรวมข้อมูลเกี่ยวกับบุคคลที่ได้ถูกดำเนินคดีจากกฎหมายหมิ่นฯ จากการใช้สิทธิแสดงความเห็น” โฆษกระบุ
โฆษกประจำตัวข้าหลวงใหญ่เพื่อสิทธิมนุษยชนแห่งสหประชาชาติ ระบุอีกว่า มีความตื่นตระหนกต่อการที่ศาลทหารเพิ่มระยะเวลาจำคุก ซึ่งการกระทำดังกล่าวไม่เป็นไปตามมาตรฐานสากลด้านสิทธิมนุษยชน และเป็นการไต่สวนที่ไม่เป็นธรรม โดยสาธารณชนไม่สามารถเข้ารับฟังการไต่สวน และผู้ถูกตัดสินจำคุก ไม่สามารถอุทธรณ์คำพิพากษาได้
นอกจากนี้ยังระบุด้วยว่า ในหลายๆ เดือนที่ผ่านมายังเห็นว่าบุคคลที่มีความพิการทางจิต-สังคม ได้ถูกตัดสินจำคุกภายใต้กฎหมายหมิ่นฯ ในวันที่ 6 สิงหาคม 2558 ศาลทหารเชียงรายตัดสินจำคุกนายสมัคร เป็นระยะเวลา 5 ปี จากการทำลายพระบรมฉายาลักษณ์ของพระมหากษัตริย์ช่วงที่กำลังเมาสุรา โรงพยาบาลในจังหวัดเชียงรายได้ตรวจทราบว่านายสมัครมีโรคทางจิตและอยู่ระหว่างการรักษาอาการประสาทหลอนทางตาและหู ในวันที่ 25 กรกฎาคม นายทะเนช ถูกศาลอาญากรุงเทพฯ ตัดสินจำคุกเป็นระยะเวลา 3 ปี 4 เดือนจากการส่ง URLs ที่มีข้อความหมิ่นพระบรมเดชานุภาพไปให้ผู้ดูแลเว็บไซต์แห่งหนึ่ง โดยมีรายงานว่านายทะเนชป่วยเป็นโรคจิตชนิดหวาดระแวง
โฆษกประจำตัวข้าหลวงใหญ่เพื่อสิทธิมนุษยชนแห่งสหประชาชาติเรียกร้องให้ศาลทหารต้องมีการรับประกันตามหลักกระบวนการอันควรของกฎหมาย ( Due process of law) ภายใต้กฎหมายสิทธิมนุษยชนระหว่างประเทศทุกกรณี และเรียกร้องให้ปล่อยตัวผู้ที่ถูกพิพากษาจำคุกอันเนื่องจากใช้สิทธิในการแสดงความคิดเห็น รวมถึงเรียกร้องให้รัฐบาลทหารแก้ไขกฎหมายหมิ่นพระบรมเดชานุภาพให้เป็นไปตามมาตรฐานสิทธิมนุษยชนสากลระหว่างประเทศ โดยระหว่างที่ยังไม่มีการแก้ไขกฎหมาย ไม่ควรนำมาตรา 112 มาใช้ตามอำเภอใจ เพื่อจำกัดการแลกเปลี่ยนความคิดเห็นของประชาชนในประเด็นที่เป็นประโยชน์สาธารณะ แม้จะเป็นการวิพากษ์วิจารณ์ประมุขของรัฐหรือผู้นำรัฐบาลก็ตาม
